If part of a property is temporarily unoccupied, you may be able to claim a reduction in your Business Rates for the unoccupied part.  A reduction in rates in these circumstances is often referred to as Section 44a Relief. From 1st April 2008 such a reduction in rates can only be applied for a maximum of 3 months in respect of commercial property or for a maximum of 6 months in respect of industrial property.

This reduction only applies to a temporary situation.  The intention is to provide help for ratepayers who are moving into or out of a property in stages.

 

If you think you may be eligible for a reduction, please write to Customer and Benefits Services, Town Hall, High Street, Skipton, BD23 1AH, and enclose the following information:

  1. Details showing which part of the property is unoccupied (if possible enclose a site plan)
  2. The date this part of the property became unoccupied

 

When we receive the information we will then decide if a reduction can be granted.  If so, we will request a certificate from the Valuation Officer that gives the proportion of the property’s rateable value which applies to the unoccupied part.

 

Properties that are permanently partially unoccupied

If part of your property is empty permanently, or for a long time, you can apply to the Valuation Office Agency to have the unoccupied part reassessed as a separate property.  To do this, the empty part must be capable of being rented out as a separate unit from the occupied part.

 

Please note that if you apply for a reduction in your Business Rates, you must continue to pay your original bill.  You should not withhold any part of your rates while your application is being considered.  If your application is successful, you will receive an adjusted bill and we will refund any money that has been overpaid.
