Adopted Regional Spatial Strategy (RSS)
and the
Use of Decentralised and Renewable
or Low Carbon Energy



Please note that the Regional Spatial Strategy has been adopted since May 2008 and forms part of the adopted development plan for Development Control purposes. It is not the responsibility of Craven District Council to publicise the Regional Spatial Strategy. This briefing note is sent to the agents on the basis that recent submissions have indicated that agents may not be aware of the requirements of the RSS as given below.


Craven District Council would like to bring to the attention of all agents the requirements of the Regional Spatial Strategy with regards to on-site renewable energy provision.


Paragraph 3 of RSS policy ENV5 states as follows: -

“In advance of local targets being set in DPDs, new developments of more than 10 dwellings or 1000m2 of non-residential floorspace should secure at least 10% of their energy from decentralised and renewable or low-carbon sources, unless, having regard to the type of development involved and its design, this is not feasible or viable.”

Craven District Council expects relevant developments, which are submitted as planning applications (or for pre-application discussions), to include decentralised and renewable energy or low carbon energy when required, unless it can be clearly demonstrated that such provision is not feasible or viable.

Town and Country Planning (General Permitted Development) (Amendment) (No 2) (England) Order 2008

From 1 October 2008 the Government are introducing some amendments to the definition of "permitted development" for work to residential properties.

The key change is that the previous allowance to build extensions to a property up to 70 cubic metres or 15% without planning permission will no longer apply. Instead the limits will be defined by maximum dimensions and distances.


Other changes affect loft conversions, roof alterations, other buildings in the garden, paving over the garden or drive and renewable energy equipment.

If you intend carrying out work under the "permitted development" allowance or are submitting a planning application on or after 1 October 2008, the new legislation may affect your proposals and you will need to take them into account now.

The changes do not alter the need to also obtain approval under the Building Regulations for most new work.

The Government have now published the Town and Country Planning (General Permitted Development) (Amendment) (No 2) (England) Order 2008 which comes into force on 1 October 2008. The Order amends Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (the GPDO) and puts in place a new permitted development regime for householders.

Domestic Microgeneration Equipment

The Government has announced changes to the permitted development regime for householders to encourage the installation of domestic microgeneration equipment. This clarifies that from 6th April 2008 planning permission is not required for the installation of certain types of equipment including solar photovoltaic and solar thermal panels and equipment on or within the curtilage of dwelling houses. This also includes an external building in the grounds of a dwelling house and a building which consists of flats. In addition permission is now not required for ground and water source heat pumps and flues relating to biomass heating and combined heat and power systems.

There are, however, restrictions on the size, position and location for such equipment particularly on those properties which are listed buildings or located within a Conservation Area. Details of these can be found by the following link to the new regulations.

As Regulations can be complex householders are encouraged to contact the planning department with details of their proposals in writing to receive confirmation of the position before installing any new equipment. This can be achieved by completing our Permitted Development Form.

As from 6th April 2008 the following changes to the Fees Regulations will take effect:

These are set by the government and are the same across all local authorities in England.

A fee increase of 11% (£15) for householder applications

An overall 25% increase for other fees

A new maximum fee of £250,000 (or £125,000 if an outline application) for all except minerals and waste applications, for which the maximum will go up 25% (to £65,000)

A new fee of £85 for ‘requests for confirmation that a planning condition has been fulfilled’ (or £25 where the request relates to householder development)

STANDARD PLANNING APPLICATION FORM
1App Forum


As you may be aware, from April 2008, the National Standard Planning Application form will become the only legal method of submitting a planning application for most types of planning consent (except for Minerals consent) for all Local Planning Authorities in England.

We held an Agent Forum in February to make you aware of the forthcoming move towards a standard form and to keep you informed of the process for achieving this.

The standard form known as 1APP will be put into practice in partnership with the Government’s online resource, the Planning Portal.Mr David Hand, from the Planning Portal Services, explained how the system will work and Planning Officers were available to answer any specific questions on this or the New Validation procedure.

When put into operation the 1APP form will be used for most types of planning applications and will deliver greater transparency, consistency and efficiency in the planning system.

The new form will facilitate on-line planning applications (but will also be available in paper format) and the process will make it less confusing for professionals and individuals submitting applications to different authorities.


The new form will take in a wide variety of planning consent procedures, including: Householder applications - Full planning permission - Outline planning permission, including approval of reserved matters - Listed building consent - Conservation area consent - Advertisement consent - Tree works (including trees protected by a Tree Preservation Order and trees in conservation areas) - Certificate of lawfulness of existing and proposed use or development.

Planning Start Notices

As from May 17th 2007 we are introducing a new procedure which, we hope, will help to ensure that the high quality developments that we approve are carried out in accordance with the details that we have approved.

Many planning decisions are conditional upon various details being submitted and approved to the Local Authority prior to works commencing, eg: stone & slate samples, a landscaping scheme; or, are conditional upon works being carried out prior to the main building being built, eg: the construction of improvements to the site access.

In order to alert us to when applicants begin any approved works they are requested to submit a Planning Start Notice to the Planning Department. This will enable us to remind developers, where necessary, that there are some pre-commencement conditions to be satisfied.

This should help to prevent unnecessary delays or problems further into the development works.
It is hoped that applicants will welcome this new procedure and are encouraged to utilise it.
