Changes to the planning application procedures from 1st October 2009

With effect from the 1st October 2009, the Government is introducing new procedures for some types of planning application.

Application for a Non-material amendment following a Grant of Planning Permission Town & Country Planning Act 1990 Planning (Listed Buildings and Conservation Areas) Act 1990

From the 1st October 2009 new procedures will apply where somebody wishes to make a "non-material" amendment to an existing planning permission. Under the new rules, these must now be made on a special planning application form, which will be available from the Planning Portal website from 1st October 2009. At the same time as making an application, the applicant must give notice to anyone (other than the applicant) who owns the land to which the application relates. The application must be accompanied by sufficient information to explain the proposed amendment. A “Design & Access statement” is not required.

Application For Extensions To The Time Limits For Implementing Planning Permissions And Associated Listed Building And/Or Conservation Area ConsentsTown and Country Planning Act 1990 Planning (Listed Buildings and Conservation Areas) Act 1990

Planning permissions which are about to expire can be kept alive by means of a simplified application procedure. This will apply to planning permissions which are extant both on 1 October 2009 and at the date of the application to renew. A special application form must be completed, which will be available from the Planning Portal website from 1 October 2009. A “design and access statement” will not be required for such application, and plans and drawings will not have to be provided. The fee for making such an application will be the same as the fee for a wholly new application. This new procedure also covers applications for listed building consent and conservation area consent where these are associated with a planning permission to which the new rules apply. ___________________________________________________________
