This page sets out how planning applications can be made, and how decisions are reached.  Central Government sets targets as to how long it should take to determine applications:
For minor and householder applications the target is for 80% of proposals to be determined within 8 weeks.


For major applications the target is for 60% of proposals to be determined within thirteen weeks.

Planning Portal - The Council strongly encourages applicants to submit and pay for planning applications to us online.

Process for Making an application
 
Once you have found out that planning permission is required for your proposals there are two ways of making an application.  You can either apply for planning permission:


1. online or;
2. In the traditional manner i.e. on paper.


To make a planning application in the traditional manner, you will need to:-


1. Carefully complete the relevant planning application forms
2. Submit the correct number of Site Location Plans  which may be obtained at www.centremapslive.co.uk
3. Submit the correct number of Metric Scale Drawings
4. Submit the correct fee 
5. Submit a Design & Access statement (if required)
6. Each application form will state which further documents you may require.
 
On receipt of your application it will be checked by the Planning Technicians to ensure that it is valid.


1. We follow the guidelines in the validation document which may be viewed at the back of each application form.

2. If the application is then found to be invalid, we shall contact your agent (if you have used an agent), or contact you either by telephone or by a letter.

3.The application process may not proceed until the application is valid. 


Planning Application validation guidance advice


From 1 April 2008 the Government introduced a mandatory system for the submission of planning applications known as 1APP whereby all of the councils nationwide will use the same standard application forms, whether applications are submitted in a paper format or electronically on-line.

As part of this process they have set out minimum guidelines to ensure that when planning applications are submitted all of the necessary information is sent in at the outset. This is intended to streamline the procedure by ensuring that everybody knows what is expected and hopefully this will speed up the decision-making process.

Locally the Government has encouraged Local Authorities to tailor the documents requested to their local requirements and as a result most of the Councils in North Yorkshire agreed to produce one document to simplify the process further for locals submitting applications throughout the County.

The application will then be registered and it will:


1. Be given a reference number
2. Assigned to a Case Officer
3. Be plotted on our computerised mapping system.
4. Be uploaded to view online.

You may wish to check on the progress of your application, or on any other application, you can do this Online HERE

5. The applicant, or their agent, will be sent an acknowledgement letter detailing the case officer and reference number.

Following this:

6. The Parish/Town Council will be notified
7. All neighbours which share a common boundary with the site will be notified by letter, of the application.
8. Statutory Consultees will be notified as necessary e.g. the Highway Authority or the Environment Agency
9. A site notice may be generated in some cases and will be posted on site within a week and;
10. The proposal may be advertised in the local press.
 
Key stages in the process 
The first three weeks following validation of a planning application are the statutory consultation period.  During this period:-

Neighbours may come and view the plans and make comments.  Any comments received are acknowledged and their authors are then kept informed about the application.  Comments received will be held on the planning application file which is publicly available.  Comments received are therefore they are not confidential.

The parish/town council will discuss the proposal and send comments to us and;

 

Written responses will be provided by any statutory consultees consulted on the proposal.

 

Following the end of the consultation period and prior to determination of the application, the case officer will:-

Study the application and any correspondence received during the consultation period

Visit the application site if necessary

Assess the proposal against the relevant development plan policies and National Planning Guidance

Compile a Report using all the above information, which will enable the Officer to make a recommendation of approval or refusal.

During this period the case officer may also enter into negotiations with applicants or their agents to improve the proposals that have been submitted

 

Reaching a decision

After the above has been completed a decision can then be made in respect of the application. 

Decisions can be made in two ways:

By the Councils’ Planning Committee (See forthcoming dates) where the application is considered by elected members (An information leaflet - Addressing the Committee is available to download)     or;

By the Head of Planning and Building Control using powers delegated by the Council to make decisions in respect of certain types of planning application.

Following a decision, a notice will then be issued and sent to the applicant or agent.  The notice will set out:
1. Whether the application has been approved or refused;
2. In the case of an approval:
a. any conditions that apply to the grant of permission;
b. reasons for the conditions
3. In the case of a refusal reasons setting out why the application was refused permission;
4. Rights of appeal that applicants have to contest a refusal of permission or condition applied to a grant of permission.
5. Each Approval will contain a START NOTICE which you should complete to inform us of the commencement of development works.
