If you are a charity, voluntary or community group, parish council or a group of two or more employees of Craven District Council you have the right to submit an expression of interest in running specified District Council services, where you believe you can do so differently and better. This right was introduced by the Localism Act 2011.
If we accept your expression of interest, we will run a procurement exercise, which means we will invite interested bodies to bid for the contract to run the service. This will be open to any qualified organisation to bid for, including the private sector. The organisation that submits an expression of interest may not win the contract.
Services the community right to challenge applies to
The community right to challenge applies to almost all Craven District Council services, including those which are currently contracted out to other providers.
How and when to submit an expression of interest
If you are considering submitting an expression of interest we would welcome a discussion with you as far as possible in advance. There may be ways in which we can help you achieve what you want without having to submit an expression of interest. Contact details are given at the bottom of the page.
If you still wish to, you can submit an expression of interest between 18 February and 31 March each year from 2013 onwards. Expressions of interest must be in writing, be clearly marked as an expression of interest under the community right to challenge, and sent to:

We will consider your expression of interest and we will either reject or accept your expression of interest depending upon whether it meets the statutory guidance on the community right to challenge. Before we make a final decision we may agree to you making modifications to your expression of interest.
We will need to consider our statutory best value duty (Section 3 of the Local Government Act 1999) to "make arrangements to secure continuous improvement in the way in which its functions are exercised, having regard to a combination of economy, efficiency and effectiveness". This will mean looking at the effects on the service and other linked services across Craven, not just the service and/or geographical area specified in the expression of interest.
We will let you know by 30 April of the same year the maximum period that we will take to let you know whether your expression of interest has been accepted or rejected and publish details of the service specification. We may need to specify different periods for different cases due to the nature, scale and complexity of the service to which your expression of interest relates. If the service is already contracted out, we will delay consideration of your expression of interest until we start to plan what will happen when the current contract ends.
If we accept your expression of interest, the procurement process will normally start no sooner than two months and no later than six months after acceptance. In developing the procurement process we will need to consider the length of contract likely to give best value to Craven District Council. In some service areas future requirements may be likely to change and it may be appropriate to award contracts for a relatively short time period, linked to the budget cycle, particularly during periods when the Council's budget is under pressure.
Where a procurement affects existing staff delivering the service, the Transfer of Undertakings (Protection of Employment) Regulations (TUPE) may apply.
If we reject your expression of interest we will publish the reason for rejection.
